 Description:  William Friend -vs- American Federation of State, county and Municipal Employees, Council 31: On December 1, 2014, Charging Party, William Friend, filed an unfair labor practice charge against his certified bargaining representative, the American Federation of State, County and Municipal Employees, Council 31 (Union), in which he alleged that the Union engaged in unfair labor practices within the meaning of Section 10 (a) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2012)(Act), in the manner in it processed a grievance it filed in relation to his termination from employment with the Illinois Department of Corrections. On January 28, 2015, the Executive Director of the Illinois Labor Relations Board, Melissa Mlynski, dismissed the charge after finding that certain of its allegations were outside of the six-month limitation period set out in Section 11(a) of the Act, and that the remaining allegations could not meet the intentional misconduct standard required to establish a violation of the duty of fair representation under Section 10(b)(1) of the Act.

 Description:  Labor Organizations Comprising the Springfield Building Trades -vs- Illinois Secretary of State: On January 16, 2015, Charging Party, Labor Organizations Comprising the Springfield Building Trades, filed an unfair labor practice charge with the Illinois Labor Relations Board, State Panel, alleging that Respondent, Illinois Secretary of State, violated an Order of Deferral issued in an earlier case by the Board's Executive Director, and in doing so also violated Section 10(a)(4) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2012). On February 6, 2015, Executive Director, Melissa Mlynski, dismissed the charge. Charging Party filed a timely appeal of the dismissal pursuant to Section 1200.135(a) of the Illinois Labor Relations Board's Rules and Regulations, 80 Ill. Admin. Code (sec.) 1200.135(a), and also asked to present oral argument. The Secretary of State did not file a response. Based on our review of the dismissal, the exceptions, the record, and the earlier Order of Deferral, we deny the request for oral argument because it would not benefit our understanding of the case, and based on that understanding we affirm the Dismissal.

 Description:  American Federation of State, County and Municipal Employees, Council 31; Glen Bell; Lisa Krebs; Carol Gibbs; David Johnson; Maureen Haugh-Stover -vs- Department of Central Management Services and Illinois State Labor Relations Board: This case deals with a statute aimed at increasing efficiency in the state government by reducing collective bargaining unit membership among management-level state employees. The goal of the statute is to ensure that certain employees' undivided loyalty will be to the executive branch, as collective bargaining unit membership inhibits their ability to manage subordinates with whom they share common interests as collective bargaining members. To further that stated objective, the General Assembly passed a statute that gave the Governor the authority to designate up to 3,580 state employment positions. Designate in this context means that the Governor can file a petition and, so long as the employment position qualifies for exemption under certain statutory parameters, the employee occupying that position becomes excluded from his of her collective bargaining unit.

 Description:  International Brotherhood of Teamsters, Local 700 -vs- Illinois State Toll Highway Authority: On January 23, 2015, Administrative Law Judge Deena Sanceda (ALJ) issued a Recommended Decision and Order in the above-captioned case, recommending the Illinois Labor Relations Board, State Panel, find that employees in the title of Sign Shop Manager, Sign Shop Supervisor, Road Electric Manager, Central Garage Manager, and Central Garage Supervisor employed by the Illinois State Toll Highway Authority were not supervisors within the meaning of Section 3(r) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2014), as amended, (Act), and that a secret ballot election should be conducted among those employees to determine if they wished to be represented by the International Brotherhood of Teamsters, Local 700, or have No Representation. The ALJ also recommended that the Board find that employees in the titles of Maintenance Section Managers and Maintenance Section Supervisors were supervisors within the meaning of the Act and should be excluded from the petitioned-for unit.
