Bell issued a Recommended Decision and Order in the above-captioned case, recommending that the Illinois Labor Relations Board, State Panel, find that employees of the State of Illinois, Department of Central Management Services (Employer) in the job title Technical Advisor IV who work at the Illinois Commerce Commission are not managerial employees within the meaning of Section 3(j) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2008) as amended, and that their positions be added to the existing RC-10 collective bargaining unit represented by the American Federation of State, County and Municipal Employees, Council 31 (Petitioner). The Employer filed timely exceptions to the Recommended Decision and Order pursuant to Section 1200.135 of the Board's Rules and Regulations, 80 Ill. Admin. Code Sec. 1200.135. The Petitioner did not file a response. After reviewing the record, briefs, and exceptions, we reject with the Administrative Law Judge's recommendation, and instead, find that the representation petition raises issues of fact and law that require resolution through the hearing process.
