In the Will County case, Michael Cosby was convicted by a jury for unlawful possession of cocaine in 2001 on the basis of crack cocaine found in personal property he had been carrying on his person. In the Kane County case, Hugo Mendoza was charged with unlawful use of a weapon on the basis of a handgun found in his car in 2004. The circuit court suppressed that evidence and the State is the appellant in the action.

Instead, the driver drove to his intended destination, disembarked, and was entering a house when the officer told him to get back in the vehicle.
