 Description:  Service Employees International Union, Local 73 -vs- County of Cook: On April 30, 2015, Administrative Law Judge Kate Vanek issued a Recommended Decision and Order dismissing a charge filed by the Service Employees International Union, Local 73 against the County of Cook alleging that the Respondent violated Sections 10(a)(4) and (1) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2014), as amended, when it unilaterally imposed new licensing and educational requirements for unit employees holding the job title of classification of Mental Health Specialist II (MHS II) and Mental Health Specialist Senior (MHS Senior). The Respondent employs the MHS IIs and MHS Seniors at Cermak Hospital, which services the Cook County Jail. One of the primary functions of the MHS IIs and Seniors is to screen inmates for mental health problems when they arrive at the jail so that they may be properly housed. The Job descriptions for MHS IIs and MHS Senoirs require only a bachelor's degree and do not require licensure.

 Description:  Salvatore T. Ziccarelli vs Illinois Labor Relations Board, Local Panel; International Brotherhood of Teamsters, Local 700: Petitioner Salvatore T. Ziccarelli, a correctional officer employed by the Sheriff of Cook County, filed a charge pursuant to section 10(b) of the Illinois Public Labor Relations Act (5 ILCS 315/10 (West 2000)) with the Illinois Labor Relations Board (ILRB or Board) contending his labor union, respondent Local No. 700 of the International Brotherhood of Teamsters (labor union or union), failed to fairly represent him at an employment-related arbitration in 2012. The Board dismissed Ziccarellis charge on grounds that he did not give the Board supporting evidence. When he subsequently appealed to the board, it upheld and affirmed the dismissal. In this direct appeal pursuant to the Illinois Administrative Review Act (735 ILCS 5/3-113 (West 1990)), Ziccarelli contends the board never formally requested evidence to support his charge and that his compliance with the purported deadline would have been unreasonable or unnecessarily burdensome. The board and the labor union have responded to the merits of these arguments, but also contend these are new arguments -- ones which Ziccarelli is presenting for the first time on appeal -- which results in waiver of those arguments. Accordingly, we first consider whether the arguments are new. The record and appeal lead us to conclude that the arguments are untimely raised and have been waived.

Kazanjian, on behalf of the Local Panel of the Illinois Labor Relations Board (Board), issued a Recommended Decision and Order in the abovecaptionedcases, 20 PERI 80 (IL LRB-ALJ 2003), finding that the Chicago Transit Authority (CTA) violated Section 10(a)(1) of the Illinois Public Labor Relations Act (Act), 5 ILCS 315 (2004), as amended, when it threatened certain of its employees and denied the Amalgamated Transit Union, Local 241 (Union orLocal 241), access to its property to conduct an election, in retaliation for a strike authorization vote the Union conducted in June 2001. Administrative Law Judge (ALJ) Kazanjian, however, dismissed the Union's allegation that the CTA violated Section 10(a)(1) of the Act when it issued a memorandum to certain of its employees, warning that if they engaged in certain job actions, it would discipline them. The ALJ also dismissed the CTA's complaint against the Union, finding no merit to its contentions that the Union violated Section 10(b)(1) and (4) of the Act when it conducted the strike authorization vote and maintained its position that the members of its bargaining unit have the right to strike.
