 Volume/Number:  2012
 Issuing Agency:
Description:  Barbara Brown-Frazier and National Nurses Organizing Committee: Charging Party, Barbara Brown-Frazier, filed an unfair labor practice charge with the Illinois Labor Relations Board, Local Panel, alleging that Respondent, National Nurses Organization Committee, violated Section 10(b) of the Illinois Public Labor Relations Act, 5 ILCS 315/10(b)(2010), in the manner in which it had settled a class action grievance concerning layoffs. Brosnan issued an order dismissing that charge after finding no evidence that Respondent intentionally treated Charging Party differently than other similarly situated employees or that its actions were based on anything other than a good faith assessment of the merits of the claim.

Description:  Karyn Thomas and Service Employees International Union, Local 73: On October 15. 2010, the Illinois Labor Relations Board's Executive Director, John F. Brosnan, dismissed the unfair labor practice charge filed by Karyn Thomas (Charging Party) in the above-captioned case as being untimely. The Charging Party alleged that the Service Employees International Union, Local 73 breached its duty of fair representation, violating Section 10(b)(1) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2010), as amended, by failing to resolve a grievance in the Charging Party's favor. The Executive Director determined that the unfair labor practice complained of occurred in the latter half of 2004, so the charge, not filed until 2010, fell outside the six-month limintation imposed by Section 11(a).

Description:  Darryl Spratt and Amalgamated Transit Union, Local 241: On January 6, 2012, Administrative Law Judge (ALJ) Elaine Tarver issued a Recommended Decision and Order (RDO) in the above-referenced case, finding that Respondent Amalgamated Transit Union, Local 241, violated Section 10(b)(1) of the Illinois Public Labor Relations Act, 5 ILCS 315/10(b)(1)(2010), by refusing to advance a grievance on behalf of Charging Party, Darryl Spratt, in retaliation for Spratt's having supported a candidate opposed to Respondent's president. That finding was made in default because Respondent failed to timely file an answer to the complaint for hearing. The ALJ denied Respondent's request for leave to file a late answer pursuant to Section 1220.40(b)(4) of the Rules and Regulations of the Illinois Labor Relations Board, 80 Ill. Admin. Code Parts 1200 through 1240 (Board's Rules), of for a variance pursuant to Section 1200.160 of the Board's Rules.

 Issuing Agency:
Description:  Fraternal Order of Police, Lodge No. 7 and City of Chicago: On August 22, 2013, the Illinois Labor Relations Board's Executive Director, Melissa Mlynski dismissed the unfair labor practice charge filed on April 1, 2013 by the Fraternal Order of Police, Lodge No. 7 (Union or Charging Party) which alleged that the City of Chicago (City or Respondent) violated Sections 10(a)(4) and (1) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2012), as amended (Act), when it refused to bargain in good faith over contractual terms and conditions or the collective bargaining agreement to be effective July 1, 2012. The Executive Director reasoned that the charge was untimely filed because the Union had notice on March 27, 2012 of the City's position that the parties' 2007-2012 contract would continue through June 30, 2013. On October 10, 2013, we granted the Union's request for oral argument. For the reasons that follow, we affirm the Executive Director's dismissal.
