 Description:  On July 27, 2011, Administrative Law Judge (ALJ) Sharon B. Wells issued a Recommended Decision and Order (RDO) in the above-captioned case, finding that three employees of the City of East Moline (City or Employer) within newly created positions of Assistant Director of Engineering, Senior Engineer, and GIS/CADD Coordinator are professional employees within the meaning of Section 3(m) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2010), as amended (Act). Because Section9(b) allows combined units of professional and non-professional employees only where a majority of each category of employees agrees to such a combined unit these employees status as professionals became an issue when the Employer filed a unit clarification petition seeking to expressly exclude them from an existing historical unit of City employees. The ALJ agreed with the Employer's position that the new positions were professional, and ordered a poll of the three professional employees to determine whether they wished to be included in the existing bargaining unit of City employees.

 Description:  Justice Spomer delivered the opinion of the court:The Village of Maryville (Maryville) appeals from the order of the Illinois Labor Relations Board, State Panel (the Board), dated September 30, 2008, that granted the petition of the Illinois Fraternal Order of Police Labor Council (the Council) for unit clarification of the existing bargaining unit and certified the Council as the exclusive representative for all full-time sergeant-ranked police officers employed by Maryville. On appeal, Maryville contends that the Board's decision was in error, arguing that because the sergeant-ranked police officers are deemed supervisors pursuant to section 3(r) of the Illinois Public Labor Relations Act (the Act)5 ILCS 315/3(r) (West 2006), they reverse and remand with directions that the Board enter an order denying the Council's petition for unit clarification.

Tansino issued a Recommended Decision and Order in the above-captioned case, in which he found that Foreign Service Economic Development Executive IIs (FSEDE II) employed by the State of Illinois Department of Central Management Services (Employer) were not supervisors or managerial employees within the meaning of the Illinois Public Labor Relations Act (Act), 5 ILCS 315 (2008), as amended, and that those employees should be added to the existing RC-62 bargaining unit represented by the American Federation of State, County and Municipal Employees, Council 31, (Petitioner). Pursuant to Section 1210.100 of the Rules and Regulations of the Illinois Labor Relations Board, 80 ILL. Admin. Code, Parts 1200 through 1240 (Rules), the Employer timely filed exceptions to the recommended decision, to which the Petitioner filed a timely response. After reviewing the record, briefs exceptions and response, we adopt the Administrative Law Judge's findings of fact and his conclusion that the FSEDE IIs are not supervisors within the meaning of Section 3(r) of the Act. However, contrary to the ALJ, we find the FSEDE IIs are managerial employees within the meaning of Section 3(j) of the Act. We therefore dismiss the petition.
