The goal of the statute is to ensure that certain employees' undivided loyalty will be to the executive branch, as collective bargaining unit membership inhibits their ability to manage subordinates with whom they share common interests as collective bargaining members. To further that stated objective, the General Assembly passed a statute that gave the Governor the authority to designate up to 3,580 state employment positions. Designate in this context means that the Governor can file a petition and, so long as the employment position qualifies for exemption under certain statutory parameters, the employee occupying that position becomes excluded from his of her collective bargaining unit.

The charge alleged that the Respondent (1) made unilateral changes to the job requirements of the position held by Field Appraiser Lucy Haro; (2) unilaterally imposed disciple against Haro by terminating her employement on September 8, 2014, without providing the Union with advance notice to discuss the reason and level of disciple to be imposed; and (3) refused to provide the Union with information relevant and necessary for it to perform its representational duties. The Executive Director issued a Complaint on the alleged refusal to provide the Union with relevant and necessary information, but dismissed the remaining allegations.
