- The defendant sought review in the appellate court and there, for the first time, alleged that the trial court had committed plain error by erroneously defining reasonable doubt in response to an inquiry from the jury. The appellate court ordered a new trial, but the Illinois Supreme Court did not agree with what the appellate court had done.
