  • Darryl Spratt and Amalgamated Transit Union, Local 241: On January 6, 2012, Administrative Law Judge (ALJ) Elaine Tarver issued a Recommended Decision and Order (RDO) in the above-referenced case, finding that Respondent Amalgamated Transit Union, Local 241, violated Section 10(b)(1) of the Illinois Public Labor Relations Act, 5 ILCS 315/10(b)(1)(2010), by refusing to advance a grievance on behalf of Charging Party, Darryl Spratt, in retaliation for Spratt's having supported a candidate opposed to Respondent's president. That finding was made in default because Respondent failed to timely file an answer to the complaint for hearing. The ALJ denied Respondent's request for leave to file a late answer pursuant to Section 1220.40(b)(4) of the Rules and Regulations of the Illinois Labor Relations Board, 80 Ill. Admin. Code Parts 1200 through 1240 (Board's Rules), of for a variance pursuant to Section 1200.160 of the Board's Rules.
