  • Pamela Mercer and American Federation of State, County and Municipal Employees, Council 31: On January 5, 2012, Executive Director John F. Brosnan dismissed an unfair labor practice charge filed by Pamela Mercer (Charging Party) in the above-captioned case. the Charging Party alleged that the American Federation of State, County and Municipal Employees, Council 31 (Respondent) engaged in unfair labor practices within the meaning of Section 10(b)(1) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2010), as amended (Act), by failing to adequately represent her, by doing nothing when her employer changed its practices regarding acting shift commanders, and in that the business agent for her bargaining unit of correctional sergeants was also the business agent for a separate bargaining unit of correctional lieutenants. The Executive Director dismissed the charge after finding no evidence Respondent had intentionally taken any action designed to retaliate against Charging Party or because of her status.
