  • Teamsters Local Union 700 -vs- City of Markham: On August 23, 2010, Administrative Law Judge Sharon B. Wells issued a Recommended Decision and Order in the above-captioned case recommending that the Illinois Labor Relations Board, State Panel, find that the City of Markham (Respondent), failed to timely answer the Complaint, and therefore had admitted the material allegations of fact and law. Accordingly, she recommended the Board find the Respondent violated Sections 10(a)(7) and, derivatively, (1) of the Illinois Public Labor Relations Act, 5 ILCS 315/10(a)(1), (7)(2008), by failing and refusing to execute a successor bargaining agreement. The Administrative Law Judge further recommended that the Board deny a motion filed by Teamsters Local Union 700 (Charging Party) for the award of costs and attorney's fee as sanctions for the Respondent's response to a show cause order.
