  • American Federation of State, County and Municipal Employees, Council 31 and International Brotherhood of Teamsters, Local 700 -vs- City of Evanston: On October 12, 2012, Administrative Law Judge (ALJ) Martin Kehoe issued a recommended decision and order (RDO) in the above-captioned consolidated cases finding that the Illinois Labor Relations Board, State Panel, should dismiss an unfair labor practice complaint in Case No. S-CA-11-057 alleging a violation of Section 10(a)(4) and (1) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2010), based on charges of a failure to bargain filed by the American Federation of State, County and Municipal Employees, Council 31 (AFSCME) against the City of Evanston (Employer). The ALJ further found with respect to competing unit clarification petitions filed by AFSCME in Case No. S-UC-11-015 and by the International Brotherhood of Teamsters Local 700 in Case No. S-UC-11-019, that the Board should conduct a secret ballot election to determine employee preference for representation.
