  • On October 1, 2010, Administrative Law Judge Joseph Tansino issued a Recommended Decision and Order in the above-captioned case recommending that the Illinois Labor Relations Board, State Panel, certify the Illinois Fraternal Order of Police Labor Council (Petitioner) as the exclusive representative of a unit of sworn police officers in the rank of sergeant employed by the Village of Richton Park Police Department (Employer). In his Recommended Decision and Order, the Administrative Law judge fund that the petitioned-for employees were not supervisors within the meaning of the Illinois Public Labor Relations Act, 5 ILCS 315 (2008) as amended, because they lacked authority to effectively recommend discipline with independent judgment.
