  • On March 4, 2011, Administrative Law Judge Anna Hamburg-Gal issued a Recommended Decision and Order in the above-captioned case, recommending that the Illinois Labor Relations Board, State Panel, dismiss the majority interest representation certification petition filed by the Illinois Fraternal Order of Police Labor Council (Petitioner) on the basis that all but one of the petitioned-for sergeants employed by the City of Carbondale (Employer) were supervisors within the meaning of Section 3(r) the Illinois Public Labor Relations Act, 5 ILCS 315/3(r) (2008) (Act), and on the basis that a bargaining unit of the one remaining sergeant would not be appropriate for the purposes of collective bargaining under the Act.
