Chief Justice Thomas and Justices Freeman, Fitzgerald, Kilbride, Karmeier, and Burke concurred in the judgment and opinion. An arrest in 2004 resulted in this Cook County defendants conviction for possession of crack cocaine with intent to deliver, and a six-year term was imposed.
