  • Direct appeal from the circuit court of Will County. JUSTICE BURKE delivered the judgment of the court, with opinion. Chief Justice Thomas and Justices Freeman, Fitzgerald, Kilbride, Garman, and Karmeier concurred in the judgment and opinion. In 2006, the Illinois legislature imposed a temporary, two-year, 3% surcharge on riverboat casinos whose adjusted gross receipts in the year 2004 were over $200 million.
