Justices Freeman, Fitzgerald, Kilbride, Garman, Karmeier, and Burke concurred in the judgment and opinion. This Will County defendant was 59 years old in 2003 when he went to the Bolingbrook residence of his longtime girlfriend and shot her in the head, killing her. The victim had told him she was leaving him for another man.
