  • Appellate citation: No. 1052806 (unpublished order under Supreme Court Rule 23). JUSTICE FITZGERALD delivered the judgment of the court, with opinion. Chief Justice Thomas and Justices Freeman, Kilbride, Garman, Karmeier, and Burke concurred in the judgment and opinion. In this Cook County case, the defendant held up a pedestrian on the north side of Chicago in 1999 using a BB gun. In a bench trial, he was convicted of armed robbery and received an eight-year prison term. No appeal was taken.
