Chief Justice Thomas and Justices Fitzgerald and Karmeier concurred in the judgment and opinion. Justice Burke specially concurred, with opinion. Justices Freeman dissented, with opinion, joined by Justice Kilbride. This Cook County defendant has never been brought to trial on the drug charges against him because of the granting of a motion to suppress. After he was arrested in 2001 and charged with cocaine and cannabis possession, he complained that Chicago police had pursued him across the border into Indiana and arrested him there. Indiana statutory law requires that an arrestee be brought for a bond hearing before a judge in the Indiana county of the arrest.
