- JUSTICE THOMAS delivered the judgment of the court, with opinion. Chief Justice Fitzgerald and Justices Freeman, Kilbride, Garman, Karmeier, and Burke concurred in the judgment and opinion. This defendant was charged with robbing a Peoria bar at gunpoint along with two other men in 2004. At his jury trial, he chose to testify, and, when defense counsel asked if he had committed the crime, he said: No sir. There is no possible way that I could have committed this crime. I mean people who commit robberies, things like that, have a motive, have a reason for doing things like that.
