  • JUSTICE KARMEIER delivered the judgment of the court, with opinion. Chief Justice Kilbride and Justices Freeman, Thomas, Garman, Burke, and Theis concurred in the judgment and opinion. A medical malpractice plaintiff filed an action in 2007 against a physical therapy assistant and his employing company, and a dispute arose as to what category of person had to sign the health care professionals report which was statutorily required in medical malpractice cases. The circuit court of Tazewell County dismissed the action on this issue, but the appellate court granted additional time, and the defendant was granted leave to appeal to the supreme court.
