  • JUSTICE THOMAS delivered the judgment of the court, with opinion. Chief Justice Kilbride and Justices Freeman, Garman, Karmeier, and Theis concurred in the judgment and opinion. Justice Burke took no part in the decision. This Boone County respondent was adjudicated a sexually violent person in 2004, and was placed in the custody of the Department of Human Services. On July 3, 2007, the circuit court stated that he should be placed on conditional release and that a conditional release plan should be presented. The State did not want Hernandez to be released and filed a notice of appeal on August 20, 2007.
