- JUSTICE FREEMAN delivered the judgment of the court, with opinion.Chief Justice Kilbride and Justices Thomas, Garman, Karmeier, Burke, and Theis concurred in the judgment and opinion. Defendant, Robert G. McDonough, was charged in the circuit court of Jersey County with driving under the influence of alcohol(625 ILCS 5/11501(a)(2) (West 2008)). Defendant filed a motion tosuppress evidence and quash arrest. The circuit court granted defendants motion and subsequently rescinded the statutory summary suspension of his drivers license. The State appealed to the appellate court (see 210 Ill. 2d R. 604(a)). A divided panel of the appellate court reversed the circuit courts order to suppress evidence and quash arrest and remanded the cause to the circuit court for further proceedings. 395 Ill. App. 3d 194.
