- JUSTICE THOMAS delivered the judgment of the court, with opinion. Chief Justice Fitzgerald and Justices Freeman, Kilbride, Garman, Karmeier, and Burke concurred in the judgment and opinion. In Urbana, James Hurlbert was arrested in October of 2003 for driving under the influence of alcohol. Taken to the Champaign County Jail, he declined to submit to a breathalyzer test, and, thus, pursuant to statute, his driving privileges were summarily suspended.
