- JUSTICE FREEMAN delivered the judgment of the court, with opinion. Chief Justice Fitzgerald and Justices Thomas, Kilbride, Garman, Karmeier, and Burke concurred in the judgment and opinion. Three Illinois counties, three Missouri counties, and the City of St. Louis are served by a mass transit system known as Metro, or Bi-State, an agency created by a Congressionally approved interstate compact between Illinois and Missouri. Such an arrangement is appropriate under the compact clause of the United States Constitution. In 2005, a collision between a bus and plaintiffs car occurred on Highway 159 in Belleville. Plaintiff sued defendant transit system in the circuit court of St. Clair County, claiming personal injuries.
