  • JUSTICE FREEMAN delivered the judgment of the court, with opinion. Chief Justice Fitzgerald and Justices Thomas, Kilbride, Garman, Karmeier, and Burke concurred in the judgment and opinion. This defendant was living in St. Charles in 2003 when he was charged with unlawful possession of child pornography. A person to whom he had given access to his residence found video clips that were turned over to police.
