- JUSTICE FREEMAN delivered the judgment of the court, with opinion. Chief Justice Fitzgerald and Justices Thomas, Kilbride, Garman, and Karmeier concurred in the judgment and opinion. Justice Burke specially concurred, with opinion. In 2004, Chicago police arrested this defendant after he was observed standing outside a building and, from individuals who came, taking money in return for items retrieved from a plastic bag in a doorway. That bag contained smaller bags which were later determined to be heroin.
