  • Direct appeal from the circuit court of Du Page County. CHIEF JUSTICE FITZGERALD delivered the judgment of the court, with opinion. Justices Thomas, Kilbride, Garman, and Karmeier concurred in the judgment and opinion. Justice Freeman specially concurred, with opinion, joined by Justice Burke. In 2004, a 16-year-old girl was found dead in the bathtub of her mothers townhouse in Aurora.
