  • The Employee Classification Act, which became effective in 2008, addresses the practice of misclassifying employees as independent contractors in the construction industry. In this case from Franklin County, the Illinois Supreme Court upheld the circuit courts rejection of a businesss facial challenge, on vagueness grounds, to the constitutionality of the Act.
