- This case involves a labor dispute between a union and an Illinois municipal employer under the Public Labor Relations Act (Act)(5 ILCS 315/10(a)(West 2006)). In 2009, the Illinois Labor Relations Board, State Panel (Board), found that the Village of Oak Lawn (Village) committed an unfair labor practice by refusing to bargain with the Oak Lawn Professional Firefighters Association, Local 3405 (union), over minimum manning requirements -- a mandatory bargaining subject -- and ordered the Village to rescind any changes it made to shift staffing and make whole any employees who incurred losses due to the violation. An arbitrator held a hearing and reviewed the bargaining agreement. The arbitrator ordered the Village to pay $285,866.72 in back pay to the employees it did not call in for overtime to meet the minimum manning requriement.
