  • American Federation of State, County and Municipal Employees, Council 31 and County of CookOn November 16, 2010, Administrative Law Judge (ALJ) Deanna Rosenbaum issued a Recommended Decision and Order in the above-referenced case, recommending that Nurse Managers and Tour Supervisors (collectively, Nurse Supervisor Is or NSIs) employed by the County of Cook (Employer) at its Oak Forest Hospital be found to be public employees and not supervisors within the meaning of the Illinois Public Labor Relations Act, 5 ILCS 315 (2008), as amended, (Act), and that they be included in an historical bargaining unit represented by American Federation of State, County and Municipal Employees, Council 31 (Petitioner of AFSCME). The Employer filed timely exceptions pursuant to Section 1200.135(a) of the Rules and Regulations of the Illinois Labor Relations Board, 80 Ill. Admin. Code, Parts 1200 through 1240 (Rules), and AFSCME filed a timely response. After reviewing the record, briefs, exceptions and response, we adopt the ALJ's Recommended Decision and Order, as discussed below.
